PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.wisecode.ai (the “Site”) or our mobile applications (the “App”).

PERSONAL INFORMATION WE COLLECT

We will collect your name and age as part of this process. After account creation, users have the option to add their dietary preferences and allergens to personalize their experience. In addition, when you visit the Site or the App, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site or use the App, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site or App, and information about how you interact with the Site or App. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

- “Log files” track actions occurring on the Site or App, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

- “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site or App.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Dietary Information.

Real Time App Permissions

Push Notifications: By enabling push notifications, you allow us to send you real-time updates, reminders, and promotional messages. You can choose to enable or disable push notifications at any time by adjusting your device settings. We may use unique device identifiers to deliver these notifications.

Camera Access/Permission: The App may request access to your device’s camera in order to enable features such as capturing photos, scanning QR codes, or supporting video calls. Camera access will only occur after you provide explicit permission. Images or videos captured are used solely for the intended purpose and are not stored or shared without your consent, except as required by law.

Location Services/Permission: Certain features may require access to your device’s location information. We will only collect and use location data with your explicit consent, and solely for purposes such as providing location-based services, navigation, or localized content. Location data is only retained as long as necessary for the stated purpose and is not shared with third parties, except as required by law.

User Controls

You may review and manage your permissions at any time by accessing your device or account settings. Refusing or revoking certain permissions may impair app functionality.

HOW DO WE USE YOUR PERSONAL INFORMATION?

WISEcode™ will use your dietary restrictions to help recommend certain foods to you. We use the Dietary Information that we collect from your scanned items and generally to fulfill any orders placed through the Site or App (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Dietary Information to: Communicate with you (including via email, SMS, in-app messages and push notifications); When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site or App (for example, by generating analytics about how our customers browse and interact with the Site or App, and to assess the success of our marketing and advertising campaigns).

Opt Out

Email/SMS marketing communications. Users are enrolled automatically when the User registers an account with our App or via a signup option on our website. To opt out, you can email ‘privacy@wisecode.ai’ or click “unsubscribe” in any text or email communication.

AGGREGATED AND ANALYTICS INFORMATION

We may use analytics tools, including Google, HubSpot, Facebook, LinkedIn, Tiktok, Segment, AppNexus, Microsoft and Mixpanel. These tools help us understand users’ behavior on our sites and applications, including by tracking page content, and click/touch, movements, scrolls, and keystroke activities. The privacy practices of these tools are subject to their own policies and they may use their own cookies to provide their services. From time to time, we may use additional or alternative analytics services. We will provide a notice of these changes on our website, and through email or other available electronic means.

We use anonymous, statistical or aggregated information, which may be based on extracts of your personal information, for legitimate business purposes including for testing, development, control and operation of the Service. We may share such information with our partners. It has no effect on your privacy, because there is no reasonable way to extract data from the aggregated information that can be associated with you. We will share your identifiable information only subject to the terms of this policy, or subject to your prior consent.

COMMUNICATION

WISEcode uses Braze, a company based in the United States, to help facilitate communication with you via in-app messages, push notifications and emails. Such communications may include information about your account, essential app updates, or insights and recommendations based on data you have tracked. For this purpose, Braze processes your email address, name, user identifier, certain tracked health data, and usage data. SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above.  

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

DATA RETENTION

When you scan a product or place an order through the Site or App, we will maintain your account and Dietary Information for our records unless and until you ask us to delete this information.

California Privacy Rights

If you are a California resident, California Civil Code grants you certain rights. To make such a request, please contact us at privacy@wisecode.ai.

Your rights

WISEcode will not sell or share your Data as such terms are defined in the California Privacy Rights Act (“CPRA”).  CPRA creates rights which include:

1. the right to correct inaccurate personal information;

2. the right to limit use and disclosure of sensitive personal information

3. the right to know (request disclosure of) personal information collected, from whom it was collected, why it was collected, and, if sold, to whom;

4. the right to delete personal information collected;

5. the right to opt-out of the sale of personal information (if applicable);

6. the right to opt-in to the sale of personal information;

7. the right to non-discriminatory treatment for exercising any rights; and

8. the right to initiate a private cause of action for data breaches.

Response to Requests

You have the right to request access to your personal information, correct inaccuracies, or delete your data by contacting us at legal@wisecode.ai. We will respond within 45 days or as required by law.  When you ask us to exercise any of your rights under this policy and the applicable law, unless you make the request from the account’s administrative owner, we may need to ask you to provide us certain credentials to make sure that you are who you claim you are, to avoid disclosure to you of personal information related to others and to ask you questions to better understand the nature and scope of data that you request to access.

SECURITY MEASURES

WISEcode uses commercially reasonable efforts to secure and protect personally identifiable information.  These processes include encryption, access control, password policies, data retention procedures, and related measures.

MINORS

The Site and the Apps are not intended for individuals under the age of 18.

CHANGES

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
